**Needless to say, since coronavirus entered the world scene in early 2020 things have had to change. This includes golf. The way we play it, and the way we spectate it.**

It’s only a few months ago stringent Covid-19 restrictions forced professional golf tournaments around the world on hiatus indefinitely. Gratefully, although a pandemic-shuffled tour schedule, the year’s first and only PGA major has ushered back the sport in a major way.

There were no spectators present at [TPC Harding Park ](https://tpc.com/hardingpark/)last week, but the millions who watched on TV and through live streaming had a bittersweet taste of what the future of the sport may look like.

## Social distancing rules

Viruses are a fiddly thing. They spread like wildfire and are tough to protect against.

Restrictions have been needed to contain the spread. This has cause upheaval in our ordinary lives and we have had to pivot around the way we normally do things. The phrase “social distancing” has forever made its way into our day-to-day vocabulary.

The restrictions on public gatherings, to ensure social distancing, have caused major disturbance across this year’s Tour’s schedule. The constraints forced officials to cancel July’s British Open and to shift the PGA Championship from May to August. The US Open was also shuffled from June to September and the Masters from April to November.

And even though Australia has now been able to ease most of these restrictions (Victoria excluded) there are still many factors at play before we get back to our regular calendar of major public events.

The vast majority of the industry agrees that if golf, or any sport for the matter, can carry on during this pandemic, it will be without fans.

## Silence, please

The 102nd PGA Championship played on the weekend (August 6-9), taken out by Collin Morikawa, was not only viewed as a triumph for him, but for the PGA of America and sports fans everywhere. While Covid-19 still lingers, this championship was a major step toward normalcy. For players and for viewers.

There may not have been any spectators, but the millions who watched from a safe distance on TV and through live streaming were still able to watch Morikawa hit one of the greatest shots in the history of golf.

And it was a product of what tournament officials and the Tour have been planning for – a TV-only sport and a fundamentally different product to what we’re used to.

The lack of crowd noise has forced broadcasts to get creative, in golf as well as other sporting events. For instance, Germany’s top football league the Bundesliga has a sound engineer pipe ‘fake’ crowd noise into the broadcast to create atmosphere for players and spectators. The AFL has had similar effects in discussion.

In golf some broadcasters have filled the audio void with mic’d up players during their rounds as well as “confession cams” where players can answer a question mid-round.

The results have been mixed, according to Golf Digest.

## How will the new format impact players?

Some pros have been anticipating an atmosphere like they had in college, with no fans and a lack of energy the crowd usually brings.

“That will be really weird,” said Erik van Rooyen ahead of the PGA Championship on the weekend. “I haven’t played a million majors yet, so I’m still always in awe of the crowds and the atmosphere. Will be very strange to not have that \[at Harding Park], and I’m not sure it will really have that major feel.”

“You miss the positivity, the energy,” said Martin Kaymer, whose round of 4-under 66 put him within one of the lead after the morning action Thursday. “But you have to create it somehow yourself.”

While the absence of spectators and the presence of masks and hand sanitizers has a new and uncomfortable feel for many, other just wants to get on with the game.

“I’ve played in tournaments where there’s nobody around so it’s kind of normal for me,” said Jeff Hart, one of the 20 club pros in the field last week.

“It’s just different,” Tiger Woods said. “That’s probably the only way to say it. This is what we’re going to have to get used to in the near future, and for probably for a while.”

“Maybe \[it’s] a little easier, if anything, just because you’re not worrying about crowd noise, or telling someone to be quiet, or moving in your guy’s swing. There’s none of that, for the time being. But other than that, I haven’t noticed a huge difference in my job or our routine.”

## Sports around the world

As various sports leagues and tournaments around the world are now slowly making a come back, the way forward isn’t crystal clear.

In America, the NBA and Major League Baseball plans to resume will initially not include fans in the stands and the NFL and college football are still wrestling with whether their seasons this fall can include fans in attendance.

But some sports and organisers seem to be moving quicker than others. NASCAR’s top series has already held 10 races over the past month. The All-Star Race on July 15, moved to Bristol, Tenn., from Charlotte Motor Speedway, allowed up to [30,000 in the stands](https://www.msn.com/en-au/news/world/nascar-moves-all-star-race-to-bristol-plans-for-30000-fans/ar-BB15x8CF).

**How could it possibly be safe, you might ask?**

“It’s not that hard,” said Charlotte Motor Speedway executive vice president Greg Walter. He is convinced that sports can proceed although in a vastly different manner. “We are over-thinking it. It’s common sense. It’s attention to detail. But it’s really not that hard.”

Every procedure — from how fans enter and leave a venue or arena, to where they sit, to how they get tickets or get food and beverages — must be reviewed and pivoted, according to Walter.

He believes the hardest part will be satisfying fans’ concerns about catching the virus, and showing commitment to putting measures in place to protect people from getting sick.

If we want sports to return, and if we want life to return to some sense of normalcy, we have to accept that things will have to be done differently, and that it is the new normal.

Event organisers will have to make sure soap dispensers don’t run empty and that people are wearing face mask and keeping the distance.

**Other changes will be more complicated.**

How are we going to avoid making hundred or thousands of people waiting on public transport after the event? How are we going to avoid hour-long delays at entry when having to temperature-check patrons entering the premises? And how are we going to manage the contact tracing and distancing requirements, all while keeping evenst running on schedule?

These types of scenarios may not seem to have a practical solution right now. But, these are questions which we need answers to in order for the sports to return again.

## What about Ryder Cup?

Just as the industry agrees that spectators must not be present during some major events during the pandemic, the industry also agrees that some events might not suit a crowd-less format.

Players and organisers alike has understood that holding a Ryder Cup without spectators would remove one of the central elements of the competition.

“It goes without saying, really, that we’re hopeful that we can do it with fans, but that remains to be seen,” PGA of America Seth Waugh told Golf Digest.

“If we can’t have fans, I think we have to kind of go back to the drawing board and talk about it at length. The Ryder Cup is unique. I mean, every event needs fans and every major needs fans. But certainly our event or the Masters would not be the same. The Ryder Cup is all about the fans.”

The organisers have considered all options, including playing with a limited attendance, but the event’s stakeholders and some players agrees, a crowd-less format would dilute the magic of the occasion.

“The players are the ones that make the Ryder Cup,” said Rory McIlroy. “If they are not on board with it and don’t want to play then there is no Ryder Cup. “I see it being [pushed back until 2021](https://www.golfdigest.com/story/ryder-cup-postponed-until-2021) and, honestly, I think that will be the right call.”

The full ramifications of crowd restrictions may yet to be fully evaluated, for players, and viewers. But last week should still be viewed a major step forward in the sport’s future viability and give some hope for the year’s remaining events.

Hopefully, when people look back on the first major golf championship after the Covid-19 restrictions eased, they will remember people’s, player’s and organiser’s tenacity in keeping the game on it’s feet, crowd or no crowd.

## **Covid-19 impacted golf events:**

The Masters at Augusta National Golf Club has been rescheduled for Nov. 12-15 from April 9-12.

The U.S. Open at Winged Foot Golf Club, Mamaroneck, New York, is rescheduled to Sept. 17-20 from June 8-21.

The Ladies Professional Golf Association (LPGA) has cancelled the Dow Great Lakes Bay Invitational from July 15-18 due to the pandemic.

The Women’s PGA Championship has been postponed from late June to Oct. 8-11.

The Australian PGA Championship will take place at the Royal Queensland Golf Club from Dec. 3-6.

Golf’s Asian Tour said it is planning to resume its 2020 season in September with the Shinhan Donghae Open in South Korea.


Are crowd-less golf events the new normal?

**Who ever said that golf is not a contact sport has clearly never been struck by a golf ball.**

FORE!!!

Imagine you had a busy week at work so you got distracted, or your hands were a bit shaky or your vision blurred after a few too many cold ones at the clubhouse. So you shank your tee shot (to the great amusement of your mates), and unintentionally send an errant golf ball flying through the air and into the woods, like a war missile. Heartbreakingly you watch it descend, shattering the kitchen windows of one of the nearby residential units along the Fairway. Ouch! This is going to hurt your wallet.

Golf courses increasingly find themselves surrounded by more intensive housing and busier roads, which inevitable increases the risk of damage which you as a player might be liable. Courts have universally rejected the defense that the neighbour brought the nuisance upon himself and rules that a landowner is entitled to the enjoyment of his property, including freedom from golf balls replicating surface-to-air projectiles.

The golf course owner should be just as concerned. The law on liability resulting from injuries caused by errant golf balls is not clear and the damage to the golf course owner could be financial and substantial. The owner's liability depends, however, on the circumstances of each case.

**Now, imagine even worse; your soaring golf ball commits the ultimate sin and hits another player in the head. Ouch!**

Most golfers are well aware of the risk of oncoming golf balls hitting you in the head when out on the course, but few would know that the injury rate is in fact 1.8 per 1,000.

According to [Golf Digest](http://www.golfdigest.com/story/getting-hit-smith-061999), some 40,000 golfers visit emergency rooms each year after being injured on the course, usually due to wayward golf balls and dislodged club heads. Terrifying enough, even though rare, there’s even reportings of golf course accidents which have been fatal. This may also happen to a passerby, spectator, or neighbor of the golf course.

Furthermore, Golf.com recently reported that between 16-41 percent of amateur golfers are injured by golf balls annually, which has now caused for a UK based proposal by insurance companies to require golfers to wear crash helmets when playing golf **in order to reduce the financial burden of injuries.**

A spokesperson for the agency said thousands of pounds are paid out in golf related injuries, especially head injuries caused by errant golf balls, and that the sport now needs to take greater precautions and put safety measures in place.** **

The UK helmet campaign could be considered a tongue in cheek proposal that sugarcoats a serious issue with dire consequences.

Whilst wearing a helmet on course might seem ridiculous to most, increased cases of serious injury or death on (or around) Australian golf courses would suggest having steadfast insurance is vital. And golf ball incidents only scratches the surface – Swinging golf clubs, rolling golf carts and horseplay around the course can all cause considerable damage to people and property ­– which is why golf insurance is critical.

We can curse & practice swing in retrospect but the fact remains our ball is submerged on the muddy floor of an all too familiar hazard. We know it’s there so why, every week, do we end up scoop in hand trying to salvage our overpriced tour ball?

How many balls did you hit with your coach at the practice range last week? “Coach?! I’m not a pro” EXACTLY! Tour professionals spend the best part of their week preparing at the range with their trusted swing advisor so, more often than not, they are splitting the fairway & avoiding the hazards.

If there’s one thing I’ve learnt from my time in the industry, it’s that your business brand drives your sales, which drives your profit.

The brand, and the image associated with the brand, are two of the driving forces which pushed Bentley Motors to launch its own line of golf clubs and accessories at the PGA Merchandise Show in January this year.

The next round of the PGA Tour, the Greenbrier Classic, kicked off today and golfing fans the world-over, myself included, are ready to settle in and see if their fantasy picks come to fruition.The Greenbrier’s Vice President, Burt Baine, hadn’t dreamed of the damage that would unfold.

As we gear up excitedly though, the people of West Virginia are reflecting on the devastation that wrought their state just over twelve months ago.

I was saddened to read about the natural disaster that came quickly and without warning. It only took four hours before heavy unrelenting rain caused the waters of Howard’s Creek to flood the Snead, Greenbrier and Meadows courses as well as the historic Old White.


He watched on in horror as the ferocious rain took hold of everything in its path and started picking the resort and golf courses apart piece by piece.

“Roofs failed, gutters failed, water was coming down through chandeliers, light fixtures and elevator shafts” Baine said.

Little was left untouched by the natural disaster that shook the town. All that remained of courses renowned for their quality and beauty were ruined greens and sad piles of debris strewn across now unusable grounds.

“We had vehicles and parts of houses and things of all sorts all over the golf courses,” Baine said. “They described it as a one-in-a-thousand-year event,”

Baine said the incident seemed “surreal” at first but “then it starts to sink in that you're not going to be playing golf for a while on these courses, and we're essentially out of business.”

In a further blow to the town the Greenbrier Classic was cancelled. But of course the unimaginable damage to the golf courses and resort was nothing compared to the wider effects on the state.

I was inspired though by the reaction of the community and their ability to band together. The PGA Tour and golf community in particular rallied around those who had been hardest hit and all in all a whopping $4 million was raised.

Two-time Masters champion Bubba Watson and his wife Angie donated an incredible $250,000 after witnessing the devastation first hand.

Through community support like this and a lot of strength and hard work, things are slowly returning to normal in White Sulphur Springs.

The rebuild of the courses is now complete but by all accounts it has been a hard and expensive slog.

This really struck a chord with me as it is helping clients dodge these kind of scenarios and financial pitfalls that drive me in my work at Golf Business Australia every day.

Obviously natural disasters of this kind are unavoidable but you can limit the financial burden they place on you and ensure that you don’t have to go back to square one by seeking out the right financial services and advice.

Increase revenue for your events with a Hole-In-One prize offering

If you own or run a golf club, you'd be forgiven for thinking that the course itself is one aspect of your business that doesn't demand your time and attention. The grounds keepers have the course maintenance under control, and you're already managing so much else (and so many people) that cannot wait. Memberships going further in Western Australia

***Recent climate-related catastrophes around the county are putting an onus on Australian golf clubs and facilities to review their insurance policies – before it’s too late!***

It is old news that Australia is a country with some extreme weather. Just recently, we were in the grip of the worst drought in over 100 years, resulting in a series of wildfires across NSW, QLD, SA and VIC, which impacted homes and businesses, leaving behind entire communities in dismay.

In NSW, where people were unable to tame the fires for several months, there’s now reports of golf clubs that have suffered partial losses on their property, but the bigger impact being the loss of revenue from the disruption of normal trade.

According to [Insurance Council of Australia](https://disasters.org.au/current-catastrophes/2019/11/13/november-bushfires), to date there has been more than 23,000 insurance claims made in relations to the fires, with a total loss of estimated value of $1.9 billion.

What is important to know is, that even though most insurance policies cover you for damage caused by fire, including bushfire, generally the damage has to be cause by the actual flame. This means your club facility and assets are most likely not covered under your current policy for heat-related damage, like scorching and melting, or smoke, ash and soot damage. This includes if your home is damaged by a nearby fire or bushfire.

Natural Disaster Cover – Is Your Golf Club Protected?

There’s nothing I love seeing more in my profession than a win for the Australian golfing industry.

A 425-hectare site at Nora Creina, just 15 kilometres south of Robe in South Australia, is set to become a mega hub for golfers and tourists alike, with the development of a highly accredited course in the works

The two 18-hole links-style golf courses, which boast a clubhouse, accommodation, a cellar door, a wellness centre, a wagyu beef farm and an Aboriginal Heritage education centre, is not only going to pump an estimated $17.5 million back into the state’s economy but also generate 150 full times job opportunities.

The development of a project of this calibre, in my opinion, is going to give the Australian golfing industry the push it deserves, where our courses that aren’t in major tourism destinations, will be viewed at an international standard.

Project developer, Justin Scanlon, has been quoted in media resources saying the project at Nora Creina has been in the pipelines since 2008, but has only recently received the financial commitment and approval from the State Government it needed.

I tip my hat off to Mr Scanlon. He had a vision, saw the opportunity and stuck to instincts to create a project that will boost the region itself, tourism numbers and the image of Australia golf. I’m certainly looking forward to seeing the finished product and economic boom it will bring to South Australian golf.

Not totally surprising at this time of the year, the *weather* around the country has been a tad bit on the extreme side, alternating hot temperatures well above average, and heavy deluge with significant storm events to follow.

Queensland proshop owner stays afloat with business interruption insurance following cyclone damage

As most of your know by now, I'm getting my shoes shined ready for the Golf Business Forum in Melbourne.

## Question: What is association liability?

 

If you are a board or committee member of an association or
not-for-profit organisation (NGO) you can be held personally liable for
decisions made on behalf of that association and staff. The consequences can
lead to civil, or even criminal action.

Once
an association or organisation is registered, its separate legal status,
property, rights and liabilities continue until the company is officially
deregistered by ASIC. However, even after the business has ceased trading and
has been deregistered, obligations as a board or committee member may continue.
A fundamental duty of a company director is to cease trade while a company is
insolvent. Therefore, under certain circumstances, [directors
may be personally liable](https://www.golfbusinessaustralia.com.au/blog/board-member-responsibility-in-these-challenging-times/) for debts incurred by the company
if the company is unable to pay those debts.

*So how does this happen?*

Well.
Directors of a company in financial distress generally appoint an administrator.
This administrator may subsequently put the company into liquidation. The
liquidator then alleges the directors have allowed the company to trade while
insolvent during the six months leading up to the administrator’s appointment.

Defence
costs and the directors’ personal liability in such cases have the potential to
reach a 7-figure sum.

## Question: Can you insure my club against cybercrime?

Absolutely! Golf Business

## Question: How does a hole-in-one insurance work?

Hole-in-one
(HIO) insurance is a type of price indemnification, working just like any other
kind of insurance policy, except that instead of insuring your property against
damage or loss, you are paying a premium to eliminate the risk of having to pay
for a prize if someone is making a hole in one during your golf event.

HIO
insurance allow golf-tournament sponsors that run contests to offer punters
big-ticket prizes if they’re lucky enough to score a hole in one on a single
try. The prize indemnity permits for contest sponsors to leverage a relatively
small expenditure into a major prize, creating a buzz and generating more
tournament participants, and is a nice way to pad the numbers at the clubhouse
bar.

Effectively,
HIO assurance transfers the risk of paying out pricy award from the club or
event organizer, over to the insurance company. For the insured entity, the
cost of this type of product is far less than the unlikely, but large expense
of paying a grand-prize winner.

When
you consider all the factors, purchasing [HIO

Golf is a constantly changing landscape. Improvements are frequently being made to available facilities, which in turn create more employment opportunities and pump funds back into the economy.

I was pleased to hear that one of Sydney’s busiest golf course makeover companies, James Wilcher’s Golf by Design, had landed the contract to to rebuild Strathfield Golf Club’s new-look layout, with the first stages of work having already kicked off.

Strathfield Golf Club is one of the gems located in the heart of Sydney, providing a true challenge to golfers of all levels.

The Golf by Design Master Plan for the project was released late last year and will feature both the 18th and 8th holes finishing near the clubhouse, making the front eight and back 10 more accessible.

These projects all come at a cost, of course. Thanks to some strategic thinking of the Strathfield Golf Club management, who have undertaken a massive enhancement of the entire property with a new clubhouse and practice area included after gaining $52 million from the sale of its clubhouse and car park.

It is anticipated that the course redesign – which will involve the building of six new holes – will be completed by the end of 2017. The new clubhouse is expected to take about 24 months to be finished.

What a win. Not only for our friends at Strathfield but for Golf by Design.

The company has also been appointed to undertake the redesign of Merewether Golf Club near Newcastle. In recent years it also has redesigned Roseville, North Ryde, North Turramurra, Pennant Hills and Cromer golf courses.

The changing landscape of golf

The Managing Director of [Avid Sports Management](http://avidsports.com.au/) is firmly standing behind the sport he loves, despite people telling him the game’s popularity is in decline.

James is doing everything in his power to prove the pessimists wrong, and I commend him for it.

Mr Cooper, who operates [Golf Central](http://golfcentralbne.com.au/) at Brisbane Airport, [Club Mandalay](http://www.clubmandalay.com.au/) in Melbourne and the [Qantas Golf Club](https://www.qantasgolfclub.com/), maintains the game is still strong,  but the industry as a whole is changing shape.

With a wealth of experience in the industry, it’s impossible to ignore Mr Cooper’s belief.  He established Avid Sports Management in 2003, after working with IMG as Director of Golf for Australia and New Zealand.

It was there, that Mr Cooper oversaw facilities such as The Dunes, Moonah Links, Links Lady Bay and Kennedy Bay as well as a number of design projects with Stuart Appleby and Karrie Webb.

He also managed Hyatt Regency Coolum, Pelican Waters and Laguna Quays and held senior management positions with Accor Hotels.

Mr Cooper’s incredible efforts with Avid Sports Management have not gone unnoticed. It is quite clear that the company prides itself on thinking outside the box to deliver industry leading advice and innovative management solutions to the golf industry.

This club recently made headlines as billionaire Bill Gate’s hideaway after his
public divorce. The exclusive club has never had any trouble attracting
members, even though the fees adds up to a small fortune with an initial fee of $250,000 in addition to an annual
membership fee of $32,000.

More than play at the two
18-hole Tom Fazio championship golf courses, the 505 members enjoy access to a
15,000 square-foot Fitness and Wellness Center, an elaborate Swim Complex, and
full-service Golf and Tennis Centers.

# National Golf Links of America — Southampton, New York (US)

Membership Cost: $150,000.

Annual Membership: $10,000.

Known as one of the most perfect courses in the world and a popular club for Wall Street's rich and powerful,
this golf course with close proximity to New York (Southampton, Peconic Bay) is
invitation only and comes with an initiation of $150,000, plus $10,000 in
yearly fees.

If you’re curious to find out more about the club you’re  out of luck. Non-members are unable to peek at
their website – go ahead, try searching for it - which is exactly the way the
members like it at this exclusive venue.

# Augusta National Golf Club — Augusta, Georgia (US)

Membership Cost: Unknown (approx.$40,000)

Annual Membership: Unknown (approx. $250,000 - $500,000)

Unsurprisingly, one of the most prestigious
course in the US (if not the world) is strictly invite-only with an maximum of
300 members or so at any given time.

It has not been officially established
exactly what the cost of membership at Augusta National is, with Golf.com
estimating a club initiation fee "in the range of $40,000" and Forbes
estimating the cost to range from $250,000 to $500,000. For us deadly people it
doesn’t really matter anyways as we will most definitely not get an invite.

# Pine Valley Golf Club — Pine Valley,New Jersey (US)

Membership Cost: Unknown.

Annual Membership: Unknown.

Recently ranked the top course in the US by Golf Digest, Pine Valley is a private club, and non-members can
play only if invited and accompanied by a member. There are a great deal of
mystery surrounding the pathway to membership at Pine Valley, except the
fact that a 20 handicap is required and invitation usually comes with an
unexpected phone call. 

Member and initial fees are
largely unknown. However, considering the exclusive course has ranked ahead of
Augusta National, you could only assume the magnitude of the fees.

# The Royal and Ancient Golf Club of St Andrews – Scotland

Membership Cost: Unknown.

Annual Membership: Unknown.

Not only one of the oldest, but largely considered the most prestigious golf club in the entire world, The Royal and
Ancient Golf Club of St Andrews in Scotland is known as the "Home of
Golf". Up until recent years, the club had a male-only membership policy,
but welcomed their first honorary female member in 2015.

Unsurprisingly, memberships is
by invitation only for the 2,500 or so members from all over the world. As far
as membership fees, the old saying goes: if you need to ask, you can’t
afford.

# Baltusrol Golf Club – Springfield, New Jersey (US)

Membership Cost: $150,000.

Annual Membership: $18,500.

Voted the #2 golf Club in the US in recent years, the Baltusrol
Golf Club is a private 36-hole golf club founded in the 1890s. The club is
known as one of golfing legends \*\*Jack Nicklaus’s all-time favourite
courses after playing the course at the \*\*Baltusrol’s centennial in1995.

According to Forbes, membership at the club will cost you
$150,000 in initial fees, plus $18,500 annual charges.

# The Royal Melbourne Golf Club – Sandringham, Melbourne

Membership Cost: AU $10,000.

Annual Membership: AU $3,500.

Australia’s top courses is still going to cost you a pretty penny. Rumour has
it that an elite club like Royal Melbourne Golf Club will set you back at least
$10, 000 initially, with annual charges around $3,500.

The
36-hole golf club located southeast of Melbourne is ranked #1 in Australia (and
\#5 in the world), its courses being the oldest and most well renowned in the
country and the most celebrated

**No industry is immune to the forces of external and social change, and the golf industry is no different.**

The rise of golf tourism increases travel risks. Are you covered?

I am always amused to hear talk of the golf industry declining.

It seems clear that Mr Linde knows what he’s doing, having approved the luxurious but environmentally sustainable design that will dramatically reduce energy consumption and long-term operational costs of the facility.

These features include air conditioning that incorporates a geothermal heat pump system which is also linked to the venue’s swimming pool and hot water, along with a 30kw solar-powered photovoltaic system which is utilised to offset building energy usage.

Bravo to Pacific Dunes. While it’s a significant investment, they’re thinking long-term and strategically for not only the players but for the wider community to enjoy club facilities.

At a glance, it may seem golf is a less dangerous sport than many others, say football or cricket. But lately, golfers and spectators alike have become increasingly aware of the risks they may face out and around the golf course.

American magazine Golf Digest reported last year more than 40,000 golfers are being brought to the hospital with injuries in the United States, most caused by errant golf balls. And we all remember too well the spectator hit in the eye and blinded by a Brooks Koepka’s tee shot on the sixth hole at last year’s Ryder Cup.

With that fresh in mind, many may now wonder, what is the situation with regard to liability when someone has caused an injury on or around the golf course? Are injuries as a result of a wayward shot the responsibility of the golfer, the facility, or neither?

The law on liability resulting from injuries caused by errant golf balls is not clear and the damage to the golf course owner could be financial and substantial. The liability depends, however, on the circumstances of each case.

It is worth noting that in Australia very few cases of golf injury are reported in the legal literature, despite the fact that hospital records show a range of injuries being treated every year. Anecdotal evidence suggests that many golf-related personal injury cases are either not pursued, or are settled outside of court.

One of few cases registered in Australia occurred back in 1994, when amateur player Glen Thomas Ollier was playing in a charity golf game at the Magnetic Island Country Club, off Townsville. Ollier was hit in the head by a stray shot and suffered serious permanent brain damage. He was later awarded $2.6 million in damages by the Supreme Court in Townsville.

But the award was made against the player who hit the ball, not the golf course. Mr Ollier had however sued the golf club at trial, too, but this was dismissed and was not challenged on appeal.

**Why so?**

To understand the liability of the club we need to know about the Occupiers’ Liability Act.

Much simplified, the Occupiers’ Liability Act says that clubs must provide golfers and visitors a reasonably safe environment to play golf. This means that golf clubs must warn, or make golfers aware of, foreseeable dangers of which they might otherwise be unaware. In addition to the warning, there may be other actions that need to be taken to meet the club’s duty of care.

It is when a club is seen to fail in this duty it may be taken to a civil court. The claim would be that the club had acted negligent.

For a claim to succeed three components are needed. The club needs to breach the duty of care (careless conduct), there needs to be a causal connection between that conduct and the damage, and that it was foreseeable that such conduct would inflict that kind of damage on the person harmed.

If the duty and these three elements are established, then the negligence is established. Thereafter, consideration must be given to the extent of the defendant’s responsibility.

To ensure duty of care is upheld, golf clubs should implement a number of recommendations to protect themselves and all visitors on the premises. The golf club should carry out a formal recorded risk assessment of the course, and ensure that there are explicit warning signs, preferably on the course, where there are foreseeable risks. Clubs should also encourage golfers to report near misses.

In the case of spectators at a professional tournament, there is probably a lower expectation that shots will veer off line as much as they do on a course played by amateurs. However, in the knowledge of recent events, where even professional players hook and slice shots occasionally, event organisers must also assess the risk and take measures to ensure that it is reduced to the lowest level reasonably practicable.

In the case at the Ryder Cup, Frenchwomen Corine Remande later threatened to seek legal redress from the tournament organisers, claiming they failed in their duty of care to spectators in the gallery.

**“Fore!” – is this warning enough?**

One reported player liability case took place in Queensland in 2008, Mr Trude vs. Dr Pollard.

Both amateur players were in the same foursome playing in a tournament. Mr Trude, an experienced golfer, was the last player to take his second shot. At the time, Dr Pollard was in front of him on the golf course but well away from where Mr Trude and Dr Pollard believed Mr Trude would hit the ball.

When Mr Trude hit the ball and realised, or should have realised, that its trajectory was not as expected, but instead in the direction where he believed Dr Pollard to be waiting, Mr Trude had a duty to warn Dr Pollard of the approaching ball.

Mr Trude called out words to the effect of “Watch out Erroll” but as Dr Pollard turned the ball struck him in the eye causing serious injury and vision impairment.

Dr Pollard later sued Mr Trude.

Mr Estwick, the president of the golf club, gave evidence that a warning should be given before a player hits the ball when another person was in a position of potential risk. Dr Pollard gave evidence that he heard Mr Trude call out, “Look out, Errol” or “Watch out, Errol”. The judge rejected Mr Trude’s evidence that his call when he realised his shot was going astray was not meant as a warning but as a request to Dr Pollard to watch out for his ball lest it be lost.

The case established that the traditional warning of ‘fore’ was not required prior to a competent golfer hitting their shot.

However, if the shot was to go awry and there was the possibility of being hit, then a verbal warning of ‘fore’ or some other audible warning is expected, which is in line with the ‘Rules of Golf’, approved by St Andrews and The United States Golf Association.

“If a player plays a ball in a direction where there is a danger of hitting someone, he should immediately shout a warning. The traditional word of warning in such situations is ‘fore’.”

Interestingly, the judges were also of the opinion that the position may had been different had Mr Trude been an inexperienced or incompetent golfer.

Essentially, each case is likely to be judged on its own merits.

Golf clubs, players and event tournament organisers can obviously insure themselves against claims for negligence by taking out public liability insurance.

⛈️ __The “Act of God” Defence__

Historically, lightning strikes and severe weather events have often been categorised legally as an “Act of God” — meaning a natural occurrence so extraordinary and unforeseeable that liability cannot reasonably attach to another party.

Golf operators frequently rely on this defence.

One of the leading cases is Hames v State of Tennessee (1991), where a golfer was killed by lightning on a state-owned golf course in the United States. His widow argued the course was negligent because it lacked lightning shelters, warning systems and evacuation procedures.

Initially, an appellate court sided with the widow and awarded damages. However, the Tennessee Supreme Court overturned that decision. The Court ultimately found the lightning strike itself — not the absence of shelters or warnings — was the “proximate cause” of death. The Court also emphasised that lightning dangers are matters of common knowledge.

That ruling reinforced a traditional legal principle:

Natural weather events alone do not automatically create liability but modern courts are increasingly asking a different question, not whether the storm caused the death but whether the operator failed to respond reasonably to a foreseeable danger...

☂️ __The Modern Standard: Foreseeability and Risk Management__

Today, golf courses are expected to actively monitor weather conditions and implement reasonable safety procedures. Technology has changed expectations dramatically.

Lightning detection systems, weather radar, sirens, automated cart GPS warnings, suspension protocols and evacuation procedures are now commonplace across many courses worldwide. As these systems become industry standard, the legal threshold for “reasonable care” rises alongside them.

That issue is currently being tested in a wrongful death lawsuit arising from the death of 29-year-old golfer Raymond Baxter Jr at Bentwater Golf Club in Georgia.

Golf facilities are no longer judged solely on whether storms are natural events — they are judged on whether they responded reasonably once the risk became foreseeable.

🕵🏼‍♂️ __Assumption of Risk vs Duty of Care__

Golf operators also argue that players voluntarily assume the inherent risks of outdoor sport.

Most people understand lightning is dangerous. If thunder is audible and golfers continue playing regardless, courts may find contributory negligence or assumption of risk.

However, assumption of risk is not unlimited and courts often distinguish between obvious natural dangers, and operational failures by a venue. For example:

Did the course have a storm protocol?
Were staff monitoring radar?
Were warnings issued promptly?
Were golfers allowed to continue play after danger became apparent?
Did the course provide safe shelter?
Were evacuation procedures followed consistently?

The stronger the operational systems, the stronger the defence.The weaker the systems, the more exposure a facility may face.

🌪️ __Real Cases Beyond Lightning__

Storm liability on golf courses is not confined to lightning strikes.

In Australia, the Northern Territory Coroner investigated the death of William Brown, who died after a tree branch fell on him during a round at Darwin’s Gardens Park Golf Links.

The Coroner found the death was “preventable” and criticised inadequate inspection and maintenance of trees on the course. Recommendations followed for broader tree safety inspections on council land.

This distinction is important legally.

Unlike lightning — which is inherently difficult to control — falling trees or branches may involve:

maintenance failures,
inspection deficiencies,
ignored warning signs, or
poor risk management.

Once human negligence contributes to the chain of events, the “Act of God” defence weakens significantly.

🔮 __The Problem With Foreseeability__

The central legal battleground in nearly every weather-related golf course death is foreseeability.

Storms are natural.
But foreseeable storms create obligations.

Courts generally ask:

Was severe weather reasonably predictable?
Did the operator have enough time to react?
Did they act consistently with industry practice?
Could reasonable steps have reduced the risk?

The faster and more sudden the weather event, the harder liability becomes to establish.

For instance, recent lightning fatalities in New Jersey and Queensland involved rapidly developing storm systems where questions arose over how much warning time existed and whether golfers themselves appreciated the danger.

This is why many claims ultimately settle around operational conduct rather than the storm itself.

🧾 __Industry Expectations Are Changing__

Perhaps the biggest shift is that golf course safety expectations continue to rise.

What may have been considered reasonable in 1991 may no longer satisfy courts today.

Modern facilities increasingly implement:

live weather monitoring,
automated suspension systems,
GPS cart alerts,
mandatory evacuation procedures,
lightning shelters,
staff emergency training, and
documented storm response protocols.

As these measures become widespread, operators who fail to adopt them may struggle to argue they met contemporary standards of care.

In other words:

The legal definition of “reasonable precautions” evolves with the industry itself.

⚖ __So Who Is Culpable?__

The uncomfortable legal reality is that culpability in storm-related golf deaths often falls into a grey area.

Sometimes the weather is truly unavoidable.

Sometimes the golfer ignores obvious danger.

Sometimes the venue fails to act.

And increasingly, courts are being asked to determine where personal responsibility ends and organisational responsibility begins.

The law does not require golf courses to eliminate all risk. That would be impossible.

But it does require them to respond reasonably to foreseeable danger.

As weather volatility increases and safety technology becomes more sophisticated, the legal scrutiny surrounding golf course storm deaths is only likely to intensify.

As a golf enthusiast, Paul Watts always dreamt of creating a golf course that would cater to players of all ages and skill levels. When the opportunity arose to develop a golf facility on the site of an old industrial waste tip, Paul seized it with unwavering determination.

The challenging terrain of the site only fuelled his passion, and he worked tirelessly to bring his dream to life. In the year 2000, Terrey Hills Par 3 opened its greens to the world, providing golfers with an exceptional 18-hole day/night golfing experience - a first of its kind in Sydney.

"Back in those days, our player numbers were very low, and I was never sure about the nights. However, for the first 10 years, if it wasn't for the night golf, I'm not sure we would be here now," recalls Paul.

"Most golfers back then were novice golfers, but over the years as the course got in better and better condition, more experienced and serious golfers came along,"

__Important changes to the Player’s Personal Liability Insurance Policy__

Issued by Golf Australia Friday 20th of January 2025;

We are writing to inform you of important changes to your Player’s Personal Liability Insurance Policy offered by Golf Australia, which is a key benefit as part of your membership of an affiliated golf club.  

Golf Australia has maintained this policy on behalf of club members since 2009 and in the past 5 years alone, has paid out $3.4 million in claims to protect our members. The original purpose of the policy was to protect members from liability if they caused personal injury to another golfer/person.  The policy was established following the legal action taken by an injured golfer because of an incident at the Magnetic Island Golf Club in 1994 and subsequent court ruling in 2003.   

Golf Australia’s Player Personal Liability Policy offers up to $20 million personal liability cover for protection against litigation from a third party for damage to property or personal injury that occurs while an eligible member is playing or practicing golf. 

In recent years, it has become increasingly difficult and expensive to source this insurance on your behalf.  As the popularity of golf has grown, we have seen an increase in the number of reported incidents. Golf Australia remains committed to finding solutions that will provide Players Personal Liability Policy to Australian affiliated golfers.   

In recent months, Golf Australia has reviewed several options in respect of this policy.  In doing so Golf Australia’s primary objective has been to maintain protection for members in the event of serious personal injury, with changes to take effect from March 1, 2025, to ensure the policy remains affordable and sustainable   

__What is changing?__

Exclusions: Specific exclusions have been added for any claim, loss, damage, liability or costs and expenses incurred directly or indirectly in connection with third party property damage to:   

•	golf carts; and
•	personal electronic devices include phone, iPad, watch, rangefinder or anything similar.

Excess: There are now three categories of insurance claim:

•	Personal injury claims – NO excess will be payable
•	Property damage where a golfer is found to have followed all expected duty of care, local rules and the Rules of Golf – NO excess payable
•	Property damage where golfer is found to have acted in a negligent manner and caused damage to a third-party property - $1,000 excess is payable  

__What does the policy cover?__

The policy covers the legal liability that an eligible member of an affiliated club may incur while playing or practicing golf. It provides coverage for up to $20 million of liability for any one incident.  This includes accidental injury or damage you may cause to someone else or their property for which you were found to have caused, subject to the Exclusions of the Policy, some of which are outlined below.   

This coverage is provided automatically to individual club members although members are under no obligation to engage this insurance policy in the event of an incident.   

__What is not covered by this policy?__ 

While this is not exhaustive, this policy does not cover:   

•	Any third-party damage or personal injury caused by non-member (ie. green fee player);
•	A member's own equipment for damage or loss;
•	A member's own personal injuries sustained on a golf course;
•	Any damage that you cause to a cart that you own, hire or borrow; and 
•	Actions that deliberately cause damage or injury and are determined to be wilful conduct.

__A MILESTON will be marked this year when Australia’s premier golf insurance specialist Golf Business Australia (GBA) returns as a founding partner to the highly anticipated Golf Business Forum/PGA Expo in Melbourne this October – back to where it all started for the Sydney based company.__

Then held at the Melbourne Park Function Centre, the forum’s inaugural event became something of a catalyst for the newfangled firm, which now, some six years later has truly cemented its position in the industry as a leading provider of golf specific insurance solutions, covering over 100 golf facilities and pro shops around Australia.

Inside Golf caught up with founder and Managing Director Daniel Bateup a few months ahead of the educational event, which will be held at the CENTREPIECE at Melbourne Park this year, to hear how the company and the industry has changed since we last saw him at ‘the Forum’ in 2016.

## How does it feel being back at the Golf Business Forum?

We are excited to be back at the Golf Business Forum where it all began! In 2016 we knew no one, but we knew we were in the right place. Six years on we proudly call many exhibitors and delegates our valued customers. If it wasn’t for them, GBA would not be the success story it is today.

From an insurance standpoint, the outlook is totally different today than back in 2016. I think major global and local events as well as environmental factors have had the biggest effect on the industry’s insurance market recently, along with golf courses’ susceptibility to volatile weather conditions which has forced many insurers out of the market.

The manner of unusual weather we’ve had this year is changing the way insurance carriers evaluate property risks for golf facilities in Australia and the availability and terms of coverage they’re offering. With interest rate still low and the steep increases in preventable type insurance claims, the stakes are too high for most insurers who have little faith left in the industry. This has left Australian golf facilities with very few coverage options.

We hope this year’s expo and our continued involvement in the Golf Business Forum will grow our understanding of, and connection with, today’s golf industry and its insurance needs.

## What has ‘the Forum’ meant for Golf Business Australia?

The industry partnerships we have forged through these events and the interactions with industry peers have helped us cultivate and improve our insurance offerings. ## Finally, claim assistance on losses are now in the millions, what insurance advice would you give clubs?

No doubt the industry has had a tough run over the past few years in terms of unpreventable weather events causing havoc to golf courses. And unfortunately, this run of wet weather and flooding continues to be a massive disruption to business and substantial financial hardship as a result.

Golf Link just recently came out with a new report showing to what extent the interruption has had on golf rounds played this year, which sadly was down more than 50 per cent for inner Sydney clubs compared to previous years. So, from an insurance perspective it’s important clubs and facilities assess their risks and review their insurance policies now, to minimise the future financial effect of business interruption.

Most commercial property insurance claims focus on physical damage instead of economic loss, but as figures show, often the income impact from closing your course due to damages from catastrophic weather events is more detrimental than actual repairs. Member frustration with not being able to play on quality courses also has a long-term effect on club’s financial viability. This is why Business Interruption insurance is critical.

Holding a relevant policy of insurance usually means the difference between survival and having to close for good!

However, it’s important to also understand that the weather alone is not responsible for the volatility of the current insurance market and golf courses’ high-risk profile. Many of the million claims are so called preventable type insurance claims. These are losses relating to things within clubs’ control, like cleaning gutter and tree maintenance. These are arguable an equal contributor to the lower tolerance among insurers for clubs around Australia.

To turn it around for golf’s insurance market, the industry needs to come together as a whole and adopt good risk practices. I believe with the help of risk maintenance and practical mitigation strategies the market for many smaller clubs can turn. Things like club house maintenance programs and prevention methods as easy as cleaning gutters can see big losses in relation to storms (55% of claims) be avoided and in turn not increasing claims. Clubs just need to be educated on these practices.

By having programs in place that assist staff in identifying what could go wrong and then taking viable measures to prevent it, will help the whole golf industry to become more attractive to insurers.
